1. Agreement, updates, and eligibility
These Terms govern KISSYN, a product of Under Ellum. You must be at least 18, legally able to enter this agreement, and permitted to use the service where you live. You accept the current Terms when creating an account. When KISSYN materially changes them, a blocking notice and a control that opens the complete new version will appear at your next authenticated visit. You may accept directly after reading. You must accept the current version to continue or finish profile setup; declining signs you out and blocks member access without deleting your account.
2. Your account, profile, and Founding Member benefits
Provide accurate age and account information, protect your credentials, and report suspected unauthorized access. Do not impersonate, evade enforcement, create deceptive duplicates, or use another member’s account. Couples must use the supported couple identity and relationship fields rather than misrepresenting an individual account. A Founding Member designation is permanent, but any associated active benefit seat is limited and depends on qualifying activity. KISSYN sends an optional reminder after six days without qualifying activity. You have seven full days to return; if you do not, KISSYN may release the active benefit seat on Day 8 for another eligible member. Releasing a seat does not delete or renumber your account, remove the Founding Member designation, or initiate billing.
3. Consent and conduct
Every interaction is voluntary and revocable. Do not threaten, stalk, coerce, traffic, harass, discriminate, scam, spam, expose, blackmail, or misuse someone’s location or intimate material. Never upload sexual content involving minors, nonconsensual intimate imagery, illegal content, malware, or material that infringes another person’s rights.
4. Content, public links, album access, and permissions
You retain ownership of content you create and give KISSYN only the permission needed to store, transform, process, moderate, display, and deliver it according to your settings. Your limited public profile link is off by default and becomes viewable outside KISSYN only when you deliberately enable it; disabling it removes public access again. Requesting another member’s private album opens your approved private album to that member for review when you have one. Approval opens the requested album and lets its owner choose a 24-hour auto-lock or access until manually locked. Each resulting access grant remains open for at least 24 hours unless the album itself is deleted. Declining immediately locks the requester’s album from the declining member. These permissions end according to the applicable deletion and retention rules. Album access and location sharing do not transfer ownership or grant permission to capture, copy, or redistribute another person’s content.
5. Discovery, matching, location, Travel, and places
A usable location is required for live discovery. During the open beta, usable human profiles may discover one another without mutual identity and Looking for compatibility; KISSYN may enable reciprocal compatibility for a later launch phase. Visibility, blocks, moderation, readiness, location, and member-selected filters still apply. A match occurs when two eligible human members like each other. Unmatching removes only the acting member’s match and swipe relationship; it does not block the other member or erase prior messages. Member distance labels use the latest available GPS points and rounding; map positions remain privacy-buffered. Either can be delayed or affected by device GPS accuracy. Travel browsing does not move your public GPS. While KISSYN receives a usable live location, proximity to an approved Cruise spot may create and refresh an automatic here-now check-in within about 500 feet; it clears after a later location update shows you have left and does not publish your exact coordinates. Cruise Spots and event listings are member-contributed or owner-reviewed information—not a promise that a place is legal, open, safe, private, accessible, or appropriate. Community corrections may publish immediately while prior values and revision history are retained. Follow local law, venue rules, and the rights of people nearby.
6. Messages, requests, drafts, hookup information, expiring media, and Meet Plans
Messages are protected in transit and by account authorization and private database controls, but they are not end-to-end encrypted. KISSYN can process and store message content to operate chats. During the open beta, an otherwise eligible human member outside the recipient’s Looking for choices may send one initial message. The recipient may accept it to enable normal messaging or deny it to remove the request and prevent further delivery unless later preferences make the connection compatible. Denial is not the same as blocking. Unsent chat text may be kept locally on that device for the same account and conversation for up to 30 days; media and uploads in progress are not saved as drafts. Optional Hookup Information may include an exact address, access code, directions, notes, images, and video. Sending it deliberately shares separate frozen messages with that one conversation and may provide Apple Maps and Google Maps links based on the address. Treat access codes and exact addresses as sensitive, verify the recipient, and remove or change them outside KISSYN when appropriate. Uploaded or recorded chat video keeps only the first 15 seconds and unused source material is discarded after processing. Direct-chat video plays only after a member presses Play, does not loop, and returns to the first frame when playback ends. Chat voice and video hard-delete after seven days unless a timely safety need lawfully preserves separate evidence. The sender may download their own sent media, but device-level capture by a recipient cannot be reliably prevented. Messages cannot be unsent from another participant’s account. Do not send secrets requiring a dedicated confidential channel. A Meet Plan records shared logistics and expectations but is not a contract for sexual activity and never creates permanent consent.
7. Practice AI
Practice AI profiles are clearly labeled fictional characters, not real people or professional advisers. Practice AI starts turned off and hidden; a member must deliberately enable it. Each member’s Practice AI conversations are isolated from other members. KISSYN may process text, media, recent conversation context, and voice-note transcripts to generate automated responses, including synthetic voices when available. AI output may be delayed, unavailable, incomplete, or wrong and must not be relied on for medical, legal, financial, safety, emergency, or other professional decisions. Turning Practice AI off hides it again without changing human discovery or deleting retained conversation history. Practice AI and test profiles do not qualify for human matching or Founding Member benefits.
8. Events and private event media
A private event may have a public preview and a separate area limited to the host and approved attendees. The host controls whether exact address and arrival information appears upon approval, 24 hours before, or 2 hours before the event. Private gallery video is transformed to a 15-second loop; arrival-directions video may retain up to two minutes. Private media for a one-time event is deleted when that event concludes. If the host configured recurrence, host-owned event details and media transfer to the next instance, while invitees, attendance decisions, and attendee chat do not. Approval to attend or view private event material is revocable access, not permission to copy or redistribute it, and never implies consent to sexual activity.
9. Reports, owner review, and enforcement
A report filed from inside a conversation makes that conversation available to the owner for review; it is not limited to messages selected by the reporting member. The owner may also review conversations and uploaded photos, including private-album photos, for reports, support, safety, abuse prevention, legal compliance, and documented compliance spot checks. Each private owner access requires a stated reason and is audit-logged. KISSYN may review or remove content, restrict visibility, pause features, require verification, suspend, or terminate access to protect members and the service. Photo rejections may be appealed through the designated review process. Eligible account-enforcement decisions may also be appealed.
10. Notifications, deletion, service changes, and responsibility
Members control optional external notification topics. Photo-decision, match, and private-album-request email may be consolidated into a 15-minute recipient window while related in-app activity and match push may remain immediate. Security, verification, recovery, and essential operational notices may use different timing. Members may choose Stealth, temporary deactivation, or permanent deletion. KISSYN may release updates, require a refresh or new sign-in for security, and change or pause features during testing, incidents, maintenance, or provider outages. It does not guarantee another member’s identity, intentions, health, location, conduct, compatibility, or any Practice AI output. Final legal review will add jurisdiction-appropriate warranty, liability, indemnity, governing-law, dispute, and consumer-rights language without asking members to waive rights prematurely.
